Do I need a Will?
It is always recommended that everyone makes a Last Will & Testament, whatever their age. While no one likes to think about the need for a Will, most of those who have put a Will in place have done so for the peace of mind it offers. Once you have written a Will, you can rest assured that your loved ones will be provided for and your assets protected.
If you die without a Will (or with a Will that is not legally valid or can’t be found), then you die ‘intestate’, and your property (the estate) must be shared according to the rules of intestacy. Essentially, this means that your assets may not go to those you would have chosen and instead may be spent or lost when they could have been safeguarded for future generations. Furthermore, if you leave behind children under the age of 18, it will be for the Court to decide who shall be their legal guardian, and this may not be the person you would have chosen.
By putting a Will in place, you can ensure that your estate passes to those you want to inherit. When you write your will with ELM, you may choose who you would like to act as Executor to administer your estate after your passing. Furthermore, our standard Will allows you to appoint guardians to take care of any children you have under the age of eighteen.
